Hearing Tuesday on Stenson manuscript

(Port Angeles) -- A Clallam County judge is ordering a manuscript written about the first trial of Darold Stenson be turned over to the court.

The never-published manuscript was written by the elderly mother of Clallam County prosecutor Deb Kelly.

Judge Brooke Taylor says he'll issue a subpoena for a copy of the manuscript.

Stenson is being retried this month for the double murder of his wife and business partner near Sequim in 1993. His previous conviction and death sentence were tossed out by the state Supreme Court.

Kelly's mother wrote the manuscript after observing Stenson's first trial. Stenson's attorneys say Kelly should be tossed from the case because she may have impartiality and a conflict of interest because of the writing.

Kelly wrote in court papers that it is a non-issue.

A hearing on the motion is set for tomorrow.

Stenson's re-trial begins next Monday. It has been moved to Kistap County.
